TO ALL TEXAS MOTOR CARRIERS from TXDOT

The 78th Texas Legislature recently passed a Bill that requires all employers that have commercial vehicle(s) complete a Supplemental Motor Carrier Application.

Below are the items listed from their July 15, 2003 that are drug and alcohol test related:

· Effective September 1, 2003, all motor carriers must certify that they are in compliance with the drug testing provisions contained in 49 C.F.R., Part 382 (SB 1904). TxDOT will request such certification when carriers submit new applications, renewal applications and supplemental applications.

· Effective September 1, 2003, all motor carriers that belong to a drug-testing consortium (a service agent that provides or coordinates one or more drug and/or alcohol testing services to DOT regulated employers) as defined by 49 C.F.R. Part 382 must inform TxDOT and provide the names of other Consortium Members (the persons operating the consortium) on the attached Supplemental Motor Carrier Application (SB 1904).

· Effective September 1, 2003, all motor carriers must submit positive drug test results to the DPS (SB 1904). For more information on how to submit positive test results, write the Motor Carrier Compliance Audit (MCCA) Section Supervisor, Motor Carrier Bureau, 6200 Guadalupe, MSC#0522, Austin, Texas, 78752-4019, or call (512) 424-2562.


The first bulleted item, you may call Forward Edge, Inc.’s Compliance Department for a letter that states your compliance status at the time you submit a new application, renew application or complete a supplemental application.

For the second bulleted item, this application has a section that requires you to disclose who is your Drug Testing Consortium. After talking with the DPS and getting clarification on the question: “Is this carrier a member of a drug testing consortium? Yes or No. If “Yes” is checked, please provide the names of consortium members in the space provided or attach a list of consortium members if necessary. Consortium Members:”, the information that is to be supplied for this is just put in Forward Edge, Inc.’s name.

For the third bulleted item: If you have an employee that had a positive drug test result, you must submit this to the DPS. The form to submit the report will be on the DPS web site. This form is not readily available but was told to me that the report will be available on September 1, 2003. The web site address is www.txdps.state.tx.us . You will then go to the section entitled “Online Services” then “Download Forms”. At this time, DPS does not have the actual title of the form.
